Court orders prosecution against Serum Institute of India and its CEO Adar Poonawalla in a Rs 10,000 crores (USD 1.19 bn approx.) defamation suit filed by Awaken India Movement’s member Mr. Prakash Pohare
- All the directors and employees of the Serum Institute of India (hereinafter referred to as SII)will also be arraigned as‘accused’ andwill face the prosecution.
- Prosecution is ordered by the Senior Division Civil Judge of the Nagpur Courtu/s 181,182,193,196,199,200,209,465,471,474, 120 (B), 34of the Indian Penal Code
- Since the defence taken by the Serum Institute, Adar Poonawalla and Cyrus Poonawalla, is found to false, therefore as per the law, the court can now grant the decree of Rs. 10,000 Crores tobe paid by the Serum Institute of India, AdarPoonawallaand Cyrus Poonawalla to the plaintiff Mr. Prakash Pohare (Tiscon Realty v. C.G. Edifice, 2023 SCC OnLine Bom 1154)
- In view of the recent judgment by the Hon’ble Chief Justice of India Mr. D.Y.Chandrachud in Naveen Singh v. State of U.P., (2021) 6 SCC 191,there is a possibility thatthe accused AdarPoonawalla, Cyrus Poonawalla and others,will not get the bail and they will be sent to jail till the conclusion of trial.
- Around 1500 more such legal suits are likely to be filed in this month across the country by the members of the Awaken India Movement against Mr. Adar Poonawalla and SII.
- Adv Nilesh Ojha, Adv. O.D. Kakde and several advocate members of Indian Bar Association have represented the plaintiff Shri Prakash Pohare.
Background:
Awaken India Movement (AIM)is a well known NGO with country wide presence. They are working persistently for dissemination of information within society regarding things that have transpired ever since global pandemic was announced in March 2020. AIM has been running several campaigns since lock down against the frauds played upon the people by the vaccine mafias and their initiatives have gained mass support from crores of people,AIM has always backed its statements and claims by scientific research and explanations from upright scientists and medical doctors.
Due to their efforts, around 80% Indians have refused to take booster doses of corona vaccines like Covishield, which has helped the country in saving lives of millions of Indians and there was no corona wave thereafter here. This has caused huge financial losses to the vaccine manufacturing companies running into crores of rupees.
Adar Poonawalla and Serum Institute had hatched a conspiracy and tried to defame Awaken India Movement and its members. The formerhad filed a false complaint before Hadapsar Police Station, Pune in the month of October, 2022. The said complaint was not acted upon by the police and was subsequently closed as it was found to be frivolous.
Then too the accused Adar Poonawalla and Serum Institute started using the said complaint before various fora and defamed Awaken India Movement and its Members.
Therefore, Awaken India Movement’s Senior member and Chief Editor of leading Marathi daily ‘DainikDeshonnati’, Shri Prakash Pohare had filed a defamation suit before Nagpur Court, claiming Rs. 10,000 Crores as compensation.
The Nagpur Court took the cognizance of the said suit and issued a show cause notice to Adar Poonawalla, Cyrus Poonawalla and the Serum Institute.
The defendant Adar Poonawalla, Cyrus Poonawalla and Serum Institute had filed a reply affidavit to oppose the said suit.
The reply affidavit and defense taken by the Adar Poonawalla and Serum Institute was ex facie false and therefore, the plaintiff Mr. Prakash Pohare had filed an application U/s 340 of Criminal Procedure Code for taking action under perjury and contempt against Adar, Cyrus Poonawalla and Serum Institute.
After conducting the enquiry and after hearing the Advocate for Plaintiff Shri. Nilesh Ojha, the court has come to the conclusion that the affidavit filed by the Adar Poonawalla and Serum Institute is exfacie false and fabricated and they are guiltyof playing fraudupon the court.
Therefore,the Court decided to become the complainant and has directed Superintendent of the Court to file a complaint case against Adar Poonawalla, Cyrus Poonawalla and Serum Institute before the Chief Judicial Magistrate.
The Court order and the proofs given by the Plaintiffs Shri. Prakash Pohare has proved that theaccused Adar Poonawalla, Cyrus Poonawalla and Serum Institute are guilty of promoting their deadly Covishield vaccine, by suppressing its serious, fatalside effects. The said Covishield vaccine was banned in various European countries due to itsdeath causing side effect.
The research from Harvard University has proved that the Covid vaccines are 98 times worse than the Covid disease.
Research hasproved that the vaccine increases the chances of cancer by 10,000%
That data and research has shown that every dose of vaccine increases the chances of death, which means if one takes the second dose, then the chances of death are increased and if you take booster dose then it again increases the death risk.

That on November 9, 2021 Canada’s Health Department has also warned about the side effects of Covishield:
In March 2021, around 18 European countries had banned Astrazeneca (Covishield) vaccine due to deaths caused because of its side effects like blood clotting post vaccination.
That the World Health Organisation (WHO) on July 26, 2021had also warned people about GBS (Guillain-Barré syndrome) beingcaused due to Covishield vaccine.

Now, since the defence of Adar Poonawallaand Serum Institute is found to be false, therefore as per Bombay High Court judgement in Tiscon Realty (P) Ltd. Vs. C.G. Edifice, 2023 SCC OnLine Bom 1154,the suit filed by Shri Prakash Pohare can be decreed directly and in that case,if Adar Poonawalla and Serum Institutewish to challenge that order, then they have to first deposit Rs. 5,000 Crores (USD 594 mn approx.) in the court.
